Application owner, offering and linking Terms

This application is owned and operated by Câmara Municipal de Lagos. These Terms set out the terms and conditions under which you can use our application and associated services. Through the “Lagos: Caravela Boa Esperança” application, you can access augmented reality experiences inside the Boa Esperança Caravel and Portuguese Discoveries Interpretation Centre and around other landmarks in city of Lagos. The application aims to “educate and entertain tourists in Lagos” by providing educational content about the history of the city.

By using our application, you approve that you have read, understood, and agree to be bound by these Terms.

 

Data collected and form of collection

When you use our application, you don't share information about your GPS position with us. We don't collect or store any information about you on our systems
In the installation process, you don't have to share sensitive data. The choice of language is only used to define the language of the application interface and the contents.
Our application doesn't import, store or use your contacts from the address book, including names, email addresses, and social network identifiers.

 

Customer support

When you contact our customer support team, we collect and store the contact information you provide (usually your name and email address), information about the activity in our application, and your network identification number. We will also store the communications you have with the customer service team and all information in those communications to provide support.

 

Sharing your information

The data collected (GPS location) is for internal use in the application and is not stored or shared with third parties.

 

Background Location Permission

We do not ask for background permission for location serviced. The device location is asked only for your location while the application is on the foreground. We never use your location permissions for advertising or analytics. Your location data is only used to show your position on the map to ease navigation. We do not ask for background permission.

Security measures

We have implemented all necessary security measures to prevent, as far as possible, any alteration or loss of your data or unauthorized access to it.

If we become aware of illegal access to personal data relating to you and correspond to processing for which we are responsible, we undertake to notify you of the incident as soon as possible if this meets a legal requirement.

Since the application is free, there is no return or refund policy.

 

Retention of the right to change offers

We may, without prior notice, change, suspend or limit the services we offer or their resources; We may terminate or suspend, permanently or temporarily, access to the services without notice and liability for any reason or for no reason.

 

Intellectual property, copyright and logos

The Service and all materials contained or transferred therein, including, without limitation, software, images, texts, graphics, logos, patents, trademarks, service marks, photographs, audio, videos, music, and all copyrights and rights related to them are the exclusive property of Câmara Municipal de Lagos. Except as expressly provided in this document, nothing in these Terms shall be considered a license and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works. The intellectual property of this application is protected by the Copyright and Related Rights Code (Decree-Law 63/85, with successive amendments). Except for the violation of moral rights, the criminal offenses provided for in the Copyright and Related Rights Code are of a public nature (they do not need an express complaint by the injured party), their participation or complaint to the police authorities being sufficient.

 

Right to suspend user access

We may permanently or temporarily suspend access to the service without notice or liability for any reason, including if you violate any provision of these Terms or any applicable law or regulation. If you wish, you can stop using the application at any time.

 

Indemnity

By accepting these terms, you agree to indemnify and/or exempt Câmara Municipal de Lagos from any legal proceedings, losses, liabilities, claims, or expenses (including attorney fees and/or court fees) made against them by any third party due to or arising from, of, or in connection with the use of the application or any of the services offered therein.

 

Limitation of liability

The application isn't a navigation system and shouldn’t be used as such. The use of the map will only inform your location and points of interest. To the maximum extent permitted by applicable law, Câmara Municipal de Lagos will under no circumstances be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including, without limitation, damages for lost profits, use of data, or other intangible losses arising out of or related to the use or inability to use the service. To the maximum extent permitted by applicable law, Blue Boats assumes no responsibility for any errors or inaccuracies in content; personal injury, or material damage, of any nature, resulting from accessing or using the application; and any unauthorised access or use of our secure servers and/or any and all personal information stored on it.

 

Right to change and modify the Terms

We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should check the terms periodically. The continued use of the application or associated services after any change constitutes acceptance of the new Terms. If you do not agree with any of these terms or any future version of the terms, do not use or access (or continue to access) our application.

 

Law preference and dispute resolution

These Terms, the rights and remedies provided herein and any and all claims and disputes related to it and/or the services will be governed, interpreted, and applied in all aspects solely and exclusively in accordance with the internal laws of Portugal, without regard to their conflicts of legal principles. Any and all complaints and disputes will be submitted and decided exclusively by a court of competent jurisdiction of the District of Faro.
